KeralaListings.com is operated by Kerala Listings ("the Company"), registered in Alberta, Canada, and in Kerala, India, operating as a global platform. These Terms and Conditions ("Terms") govern your use of the Platform and constitute a legally binding agreement between you and the Company.

By using the Platform you confirm that you have read, understood, and agree to these Terms in full. The Company reserves the right to update these Terms at any time. Your continued use of the Platform after any changes constitutes acceptance of the updated Terms.

2. About KeralaListings — Global Platform Declaration

KeralaListings.com is a global online classifieds platform built for the worldwide Malayali community. The Platform operates across multiple countries and jurisdictions including but not limited to:

Users in each country are responsible for complying with their own local laws in addition to these Terms.

3. Platform Role — Marketplace Model & Intermediary Status

KeralaListings.com operates solely as an intermediary classifieds notice board. The Platform functions like a digital notice board where users post and view advertisements. The Company:

• Does NOT own, manage, warehouse, or control any goods or listings posted on the Platform
• Is NOT a party to any transaction between buyers and sellers
• Does NOT verify the accuracy, authenticity, or legality of any listing
• Is NOT responsible for the quality, safety, or legality of listed items
• Does NOT handle, process, receive, or transmit any payments between buyers and sellers
• Does NOT guarantee that buyers or sellers will complete any transaction
• Acts purely as a technology facilitator — a digital notice board connecting buyers and sellers

4. Business Registration & Legal Structure

KeralaListings.com is a legally registered business operating under the following structure:

• Canada: Registered as a business entity in Alberta, Canada. Holds a Business Number (BN) from the Canada Revenue Agency (CRA).
• India: Operating in compliance with the IT Act 2000 and Consumer Protection (E-Commerce) Rules 2020.
• International: Compliant with applicable laws in all jurisdictions where the Platform operates.

5. User Eligibility

To use this Platform, you must:

• Be at least 18 years of age (or the age of majority in your country, whichever is higher)
• Be legally capable of entering into binding contracts under applicable law in your country
• Not be barred from using the Platform under any applicable local or international law
• Not be on any government sanctions or restricted persons list

6. Accuracy of Information & Authenticity of Content

By posting any listing, content, image, or information on KeralaListings.com, you legally declare and warrant that:

• All information you provide — including title, description, price, location, and contact details — is true, accurate, complete, and not misleading
• All photographs and images you upload are genuine, original, and accurately represent the actual item being sold or listed
• You are the rightful owner of the item listed, or you have explicit legal authority to sell or advertise it
• You have the full legal right to use and upload all images and content posted — they do not infringe any third-party copyright, trademark, or intellectual property rights
• Images posted are not stolen, downloaded from the internet, or taken from other listings without permission
• You have not manipulated, digitally altered, or misrepresented any image in a way that would mislead a buyer about the actual condition or appearance of the item
• All prices stated are genuine and reflect the actual asking price
• The item is actually available for sale at the time of posting

7. Listing Guidelines & Seller Responsibilities

As a seller ("Lister") on the Platform, you agree to:

• Post only accurate, truthful, and complete information about your listed item
• Have full ownership or legal authority to sell the listed item
• Comply with all applicable laws in your country of residence
• Include clear, genuine photographs that accurately represent the actual item
• Remove or mark listings as sold immediately once an item is sold
• Respond to genuine buyer enquiries promptly and honestly
• Disclose any defects, faults, or known issues with the item
• Not post duplicate listings of the same item

8. Buyer Responsibilities

• Conduct your own due diligence before purchasing any listed item
• Physically inspect items where possible before completing a transaction
• Verify the authenticity and ownership of listed items independently
• Report any suspicious, fraudulent, or illegal listings immediately
• Never make advance payments without adequate verification of the seller and item
• Be aware of your rights under consumer protection laws in your own country

9. Image Policy, AI Enhancement & EU AI Act Compliance

• All images must be real photographs of the actual item being listed
• Stock images, AI-generated images, or images from the internet are strictly prohibited unless clearly disclosed
• If you use any AI image enhancement tool to improve clarity of a genuine photograph, you must disclose this by adding "Image Enhanced for Clarity" in your listing description
• Any digitally manipulated image that misrepresents the item's actual condition is prohibited

10. Copyright & Intellectual Property

All Platform content including logos, design, software, and branding is the intellectual property of KeralaListings.com. By posting a listing, you grant KeralaListings.com a non-exclusive, royalty-free, worldwide licence to display and promote your listing content on the Platform and its associated social media channels.

• You retain ownership of your original content
• You confirm you have the right to grant this licence
• This licence ends when you delete your listing
• You must not copy, scrape, or reproduce any content from the Platform without written permission

11. Contact Information & Phone Number Sharing

Registered and logged-in users may access seller contact information including phone numbers. Guest users must register and log in to view contact details. By posting a listing, you consent to your contact details being visible to logged-in users in connection with your active listings only.

12. Paid Listings, Payments & Refund Policy

KeralaListings.com offers free basic listings and paid Featured and Premium upgrade plans. The following applies to all paid services:

• All fees are displayed clearly before purchase
• All payments to KeralaListings.com for listing services are processed through secure third-party payment gateways (Instamojo for India, Stripe for international)
• KeralaListings.com does NOT process, handle, or receive any payments between buyers and sellers — all buyer-seller payments are arranged entirely between the parties themselves
• KeralaListings.com does not guarantee a specific number of enquiries, views, or sales from any paid listing
• In the event of a technical error causing a duplicate payment to KeralaListings.com, a full refund will be issued within 7 working days

13. Tax Compliance

KeralaListings.com is a classifieds notice board only. We do not process, handle, or intermediate any payments between buyers and sellers. Therefore:

• KeralaListings.com is NOT responsible for collecting, deducting, or remitting any GST, TCS, VAT, or any other tax on transactions conducted between buyers and sellers through the Platform
• All tax obligations arising from buyer-seller transactions are entirely the sole responsibility of the individual buyers and sellers involved
• KeralaListings.com collects applicable taxes only on its own service fees — i.e., on the fees charged for Featured and Premium listing upgrades — in accordance with applicable law

India: GST may be applicable on KeralaListings.com's own listing service fees where required by Indian tax law. Sellers operating commercially in India are solely responsible for their own GST compliance and filings.

Canada: GST/HST may be applicable on KeralaListings.com's own listing service fees for Canadian users. Sellers operating commercially in Canada are solely responsible for their own GST/HST obligations.

International: Users are solely responsible for declaring and paying any taxes in their own country arising from transactions they conduct. KeralaListings.com will cooperate with tax authorities as required by law.

14. User Accounts

• Maintain the confidentiality of your account credentials at all times
• Be responsible for all activity conducted under your account
• Notify us immediately at info@keralalistings.com of any unauthorized use of your account
• Provide accurate, complete, and up-to-date registration information
• Not create multiple accounts for the same person or entity
• Not share your account with any other person

KeralaListings.com reserves the right to suspend or permanently terminate any account that violates these Terms, without notice or refund.

15. Cross-Border Transactions & Export/Import

KeralaListings.com is a classifieds platform and does not facilitate physical cross-border shipping. Where users independently arrange cross-border transactions:

• Sellers in India who ship goods internationally must hold a valid Import Export Code (IEC) issued by the DGFT, India
• Buyers and sellers are solely responsible for compliance with customs, import duties, and export regulations in their respective countries
• KeralaListings.com is not responsible for any goods seized, delayed, or rejected by customs authorities
• Cross-border transactions involving restricted or prohibited goods are strictly forbidden

16. Data Protection & Privacy — Global Compliance

KeralaListings.com collects and processes personal data in accordance with applicable data protection laws globally. A full Privacy Policy is available separately on the Platform.

India: Digital Personal Data Protection Act (DPDPA) 2023 and Information Technology Act 2000.

Canada: Personal Information Protection and Electronic Documents Act (PIPEDA) and Alberta's Personal Information Protection Act (PIPA).

EU & UK: General Data Protection Regulation (GDPR) 2018 and UK GDPR. EU/UK users have the right to access, correct, and delete their personal data.

China: Personal Information Protection Law (PIPL) 2021.

Japan: Act on Protection of Personal Information (APPI) as amended 2022.

Singapore & Malaysia: Personal Data Protection Act (PDPA).

Australia: Privacy Act 1988 and Australian Privacy Principles (APPs).

UAE & Gulf: Applicable data protection regulations in UAE, Qatar, Saudi Arabia, Kuwait, Bahrain, and Oman.

17. Consumer Protection Compliance

KeralaListings.com complies with consumer protection laws applicable to its own services as a platform operator. Users are individually responsible for complying with consumer protection laws applicable to their own listings and transactions in their respective countries.

18. Prohibited Activities

Prohibited Items:

• Illegal items, stolen goods, or items that violate applicable laws in any jurisdiction
• Weapons, firearms, ammunition, explosives, or military equipment
• Drugs, narcotics, controlled substances, or drug paraphernalia
• Counterfeit, fake, or pirated products
• Adult, obscene, or pornographic content
• Endangered species or wildlife products banned under CITES
• Human organs, body parts, or medical waste
• Items subject to international sanctions or embargo

Prohibited Conduct:

• Posting false, misleading, or fraudulent information or images
• Impersonating any person, business, or organisation
• Harassing, threatening, or abusing other users
• Spamming, pyramid schemes, or multi-level marketing content
• Scraping or extracting data from the Platform by automated means
• Attempting to hack, disrupt, or damage the Platform
• Creating fake accounts or using the Platform to launder money
• Using AI-generated or deepfake images without clear disclosure

19. Limitation of Liability

To the fullest extent permitted by applicable law, KeralaListings.com shall not be liable for:

• Any transaction, payment, or exchange between buyers and sellers on the Platform
• Fraudulent, inaccurate, or misleading listings posted by users
• Loss of data, profits, revenue, or business opportunities
• Any goods that are defective, misrepresented, or not as described
• Any financial loss arising from transactions between users
• Interruption or unavailability of the Platform for any reason
• Any third-party content linked to or from the Platform

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. Where liability cannot be excluded by law, our total aggregate liability shall not exceed the amount paid by that user to KeralaListings.com in the 12 months preceding the claim.

20. Disputes Between Users — Not Our Responsibility

All disputes between buyers and sellers — including but not limited to disputes about item condition, price, delivery, payment, fraud, misrepresentation, or any other matter — are entirely and solely the responsibility of the individual parties involved.

Users must resolve any disputes between themselves directly, or through their own legal channels, consumer protection authorities, or law enforcement in their respective countries. KeralaListings.com will not intervene, mediate, arbitrate, or adjudicate in any such dispute under any circumstances.

KeralaListings.com may cooperate with law enforcement authorities if required by law, but this does not constitute any acceptance of responsibility for any user dispute.

21. Reporting & Grievance Mechanism

Users may report illegal or inappropriate listings using the Report feature on each listing. All reports will be reviewed within 72 hours for the purpose of removing violating content from the Platform only.

22. Penalties for Violations

• Immediate removal of violating listings without notice or refund
• Temporary or permanent suspension of user account
• Legal action under applicable laws in relevant jurisdictions
• Civil penalty of ₹10,000 per listing posted in violation of these Terms
• Civil penalty of ₹10,000 per day for continued unauthorized access
• Civil penalty of ₹10,000 per unsolicited spam communication
• Civil penalty of ₹10,00,000 or more for unauthorized scraping or data theft
• Recovery of all legal costs and damages incurred by the Company

23. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Alberta, Canada as the primary jurisdiction, given the Company's registration in Alberta.

For users in India, matters relating specifically to listings or content within India shall additionally be subject to the applicable laws of India.

Any legal action by or against KeralaListings.com shall be filed in the courts of Alberta, Canada, or the courts of Kerala, India, as applicable to the nature of the claim.

24. Modifications to Terms

KeralaListings.com reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated date. For material changes, we will notify registered users by email or Platform notification. Your continued use of the Platform after the effective date of any modification constitutes your acceptance of the new Terms.

25. Disclaimer

KeralaListings.com does not endorse any seller, buyer, listing, product, or service on the Platform. We do not verify the identity of users or the accuracy of listings. Users transact entirely at their own risk.

KeralaListings.com is not responsible for any loss arising from reliance on any listing or information posted by third-party users. Links to third-party websites are provided for convenience only — we are not responsible for any third-party content.
