KeralaListings.com ("the Platform") is an online classified advertisements platform connecting buyers and sellers across Kerala, India. These Terms and Conditions apply to all users including visitors, registered users, sellers ("Listers"), and buyers.

KeralaListings.com reserves the right to update these Terms at any time without prior notice. Your continued use of the Platform constitutes acceptance of the updated Terms.

2. Platform Role and Intermediary Status

KeralaListings.com operates solely as an intermediary platform. We:

• Do NOT own, manage, or control any listings posted on the Platform
• Are NOT a party to any transaction between buyers and sellers
• Do NOT verify the accuracy, authenticity, or legality of any listing
• Are NOT responsible for the quality, safety, or legality of listed items
• Do NOT guarantee that buyers or sellers will complete any transaction

3. User Eligibility

To use this Platform, you must:

• Be at least 18 years of age
• Be legally capable of entering into binding contracts under applicable Indian law
• Not be barred from using the Platform under any applicable law

Minors are strictly prohibited from using the Platform.

4. Listing Guidelines and Seller Responsibilities

As a Lister, you agree to:

• Post only accurate, truthful, and complete information about your listed item
• Have full ownership or legal authority to sell the listed item
• Comply with all applicable Indian laws and regulations
• Include clear photographs that accurately represent the item
• Remove listings immediately once an item is sold

Prohibited Listings:

• Illegal items, stolen goods, or items that violate applicable laws
• Weapons, drugs, narcotics, or controlled substances
• Counterfeit or fake products
• Adult or obscene content
• Misleading, fraudulent, or deceptive listings
• Spam, pyramid schemes, or multi-level marketing content

5. Buyer Responsibilities

• Conduct your own due diligence before purchasing any listed item
• Physically inspect items where possible before completing a transaction
• Verify the authenticity and ownership of listed items independently
• Report any suspicious, fraudulent, or illegal listings immediately

6. Contact Information and Phone Number Sharing

Registered and logged-in users may access seller contact information including phone numbers and WhatsApp details. Guest users must register and log in to view contact details.

By posting a listing, you acknowledge that your contact details may be visible to logged-in and verified premium users in connection with your active listings.

7. Paid Listings and Payments

• Fees are non-refundable unless otherwise stated
• KeralaListings.com does not guarantee a specific number of enquiries or sales
• All payments are processed through secure third-party payment gateways

8. User Accounts

• Maintain the confidentiality of your account credentials
• Be responsible for all activity under your account
• Notify us immediately of any unauthorized use
• Provide accurate and up-to-date registration information

9. Limitation of Liability

KeralaListings.com shall not be liable for any damages arising from:

• Any transaction between buyers and sellers on the Platform
• Fraudulent, inaccurate, or misleading listings posted by users
• Loss of data, profits, or business opportunities
• Any dispute between users

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis.

10. Intellectual Property

All content on the Platform including logos, design, and software is the intellectual property of KeralaListings.com. By posting a listing, you grant KeralaListings.com a non-exclusive license to display your content on the Platform.

11. Privacy Policy

We collect registration information, listing details, usage data, and communication data in accordance with India's Digital Personal Data Protection Act, 2023.

We do not sell your personal data to third parties. You may request deletion of your account by contacting us.

12. Reporting and Grievance Mechanism

Report illegal or inappropriate listings using the Report feature. All reports reviewed within 72 hours.

13. Penalties for Violations

Users who violate these Terms may be subject to penalties starting from ₹10,000:

• ₹10,000 per listing posted in violation of these Terms
• ₹10,000 per day for unauthorized access
• ₹10,000 per unsolicited message or spam
• ₹10,00,000 or more for unauthorized scraping or exploitation of Platform content

14. Governing Law and Disputes

These Terms shall be governed by the laws of India. Disputes shall be resolved through mutual negotiation, and if unresolved within 30 days, referred to arbitration under the Arbitration and Conciliation Act, 1996. Jurisdiction: Courts of Kerala, India.

15. Disclaimer

KeralaListings.com does not endorse any seller, buyer, listing, product, or service on the Platform. We do not verify the identity of users or the accuracy of listings. Users transact entirely at their own risk.

16. Modifications to Terms

KeralaListings.com reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use constitutes acceptance of the new Terms.
